ASSAY OFFICE BRAND RECOGNITION
Within the scope of Article 11(1)(c) of Law Nº. 98/2015, of 18 August, as amended by Decree-Law Nº. 120/2017, of 15 September, which approves the Legal Regime of Jewellery and Assay Offices (RJOC), it is incumbent upon the Portuguese Institute of Quality (IPQ), upon the favourable opinion of the director of assay offices, to recognise in particular that:
- The informational content of the touch guarantee marks, assay office mark and touch mark, is equivalent to that of the touch guarantee marks established in the RJOC;
- The information content of the touch guarantee marks, assay office mark and touch mark is not likely to mislead the consumer;
- The marking conditions of the touch guarantee marks have been applied by a testing and marking body independent of the country that carried out the quality control and assurance, and which are equivalent to those laid down in the RJOC.
The following ordinances are also applicable within the scope of the RJOC:
- Ordinance Nº. 285/2019, of 3 September, which makes the first amendment to Ordinance No. 374-A/2017, of 31 October;
- Ordinance Nº. 333-B/2017, of 3 November, Ordinance that regulates the New Legal Regime of Jewellery and Assay Offices, approved by Decree-Law No. 120/2017, of 15 September;
- Ordinance Nº. 374-A/2017, of 31 October, establishes the marks applicable by assay offices, the provisions applicable to testing and marking and the technical requirements of articles with precious metals, under the terms of the legal regime of jewellery and assay offices (RJOC).
After analysis of the documentary process and if it is compliant, IPQ issues the certificate of recognition of the Assay Office Mark, which is valid as long as the recognition conditions are maintained, and the entity must notify IPQ of any change to these conditions, through a request for renewal of recognition.
