POINT OF CONTACT FOR BUILDING PRODUCTS

Under Article 10 of Regulation (EU) Nº. 305/2011 of 9 March, hereinafter referred to as the Construction Products Regulation (CPR), Member States are required to designate Contact Points for Construction Products (PCPC). According to the same Article, the provisions relating to the competences of the Product Contact Point (CFP) which, after reference to Regulation (EU) 2019/515 currently in force, consist in providing:

  • Information on the principle of mutual recognition and on the application of Regulation (EU) 2019/515 of 19 March 2015 in the territory of the respective Member State;
  • Contacts allowing direct contact with the competent and supervisory authorities in the respective Member State;
  • The legal remedies and procedures available in the territory of the respective Member State in the event of a dispute between the competent authority and an economic operator;
  • Useful information, such as electronic copies of national technical regulations and national administrative procedures applicable to specific goods in the territory where the product contact point is established, including whether they are subject to prior authorisation under national law.

The CPR was transposed into the domestic legal order by Decree-Law Nº. 130/2013, of 10 September, which designates, in Article 5(3)(b), the Portuguese Institute of Quality, I.P. as the national PCPC, pursuant to Article 10 of Regulation (EU) Nº. 305/2011 and Nº. 1 of the Resolution of the Council of Ministers Nº. 44/2009, of 29 May.
